BRA Board Adopts New Fenway Rooftop Zoning Amendment

The Board adopted a new zoning amendment that will address rooftop expansions to commercial establishments in Fenway. The neighborhood is now home to many diverse bars and restaurants seeking to cater to residents, office workers, and baseball patrons alike. As a result many establishments, both new and old, have expressed interest in rooftop expansion of their operations. In order to ensure sufficient community dialogue, as well as appropriate design review, the amendment will categorize any rooftop expansion of specific commercial uses as a conditional use, requiring proponents to go through a Board of Appeals process prior to being approved for any rooftop dining, seating or standing area. The amendment does not change or alter existing building code and other zoning requirements that already exist. Additionally, any rooftop expansion that seeks to expand their alcohol or entertainment license to the roof would have to address that issue with the City of Boston Licensing Board, a process that is not affected by this amendment. The amendment will now go before the Zoning Commission before it can be adopted into Article 66 of the Fenway Neighborhood Zoning.
